Raymond A. Marcaccio is the co-founder of Oliverio & Marcaccio LLP.  He was previously a partner in the law firm of Blish & Cavanagh, which is also located in Providence, Rhode Island. 

Ray enjoys a varied practice in trial and appellate advocacy, as well as conducting internal investigations for employers, and serving as an arbitrator, hearing officer and mediator.  He helps his clients navigate through litigation and other legal challenges to a successful conclusion. 

Employment Advice and Litigation

  • Defends employers against various claims of discrimination, harassment, and retaliation.
  • Brings suit to enforce restrictive covenants, such as non-compete clauses in employment contracts.
  • Represents former executives in obtaining substantial severance packages from former employers.


  • Conducts high level and sensitive investigations on behalf of employers concerning allegations of discrimination, harassment and malfeasance by employees, including chief executive officers and upper management.

General Civil Litigation

  • Represents companies and individuals in all types of civil litigation, including commercial disputes, insurance bad faith claims, and torts.

First Amendment and Constitutional Practice

  • Represents local news media organizations against defamation claims and brings claims for access to public records and court and government proceedings.  Defends public agencies and other entities against First Amendment, due process, and related constitutional challenges in both federal and state courts.

Arbitrations and Hearing Officer

  • Arbitrates and mediates employment and commercial disputes. 
  • Serves as a hearing officer for state agencies to decide a variety of cases including  pension disputes.  Ray has been called upon by the state to set the annual health insurance rates for the individual market in Rhode Island. 

Summary of Significant Cases

         Co-represented the women athletes at Brown University in a landmark Title IX sex discrimination case in federal court.

         Brought suit in federal court which has been cited by a number of other jurisdictions to recognize a common law whistle blower claim.

         Successfully litigated a bad faith claim against an insurance company for failure to pay insurance benefits.

         Successfully defended a local newspaper against a defamation claim at a jury trial brought in Providence County Superior Court.

         Represents local television stations against defamation claims pending in state court. 

         Successfully defended the president of a large shipping company in actions brought by local lobstermen after an oil spill from one of the president’s vessels.

         Obtained a defendant’s verdict on behalf of a large oil company in a jury trial in Providence County Superior Court.

         Numerous appeals before the Rhode Island Supreme Court and appearances before the United States Court of Appeals for the First Circuit.

         Investigation of a large public agency relating to allegations of misconduct and sexual harassment by chief executive officer.

         Investigation of a statewide public transit authority relating to allegations of malfeasance by chief executive officer.

         Investigation of two state agencies concerning allegations of misconduct by management, job performance, lack of appropriate oversight and adherence to applicable laws and regulations, and compliance with best practices concerning investigations into allegations of sexual assault at a local hospital.

         Investigation into municipal department concerning allegations of pervasive race discrimination and harassment.

         Investigation into malfeasance committed by chief executive officer.

Professional Achievements and Community Service

Co-Chair of the 2011 United States District Court Conference

  • United States District Court Chief Judge Mary Lisi appointed Ray as Co-Chair of the 2011 United States District Court Conference.  The conference speakers included U.S. Supreme Court Justice Stephen Breyer.

Recipient of the Public Justice Achievement Award from the Trial Lawyers for Public Justice

  • This national award is given out annually to lawyers who have made a significant contribution in the field of civil rights.

Past Member of the Commission on Judicial Tenure and Discipline

  • Appointed by the Governor and confirmed by the Senate, Ray served for five years on the Commission on Judicial Tenure and Discipline, which oversees the conduct of all members of the judicial branch for the State of Rhode Island.

  • Voted annually by his peers as a top civil litigator in the Super Lawyers publications since 2007.

  • For the past 8 years, Ray has served on the Board for the Law Center, which provides free legal assistance and advocacy to persons with disabilities.

  • The Justinian Law Society is a professional organization that promotes educational and cultural programs for both attorneys and law school students. 

Fellow of the Rhode Island Bar Foundation

  • In 2002, Ray was inducted as Fellow of the Foundation, which is a non-profit, charitable organization whose mission is to foster and maintain the honor and integrity of the profession of law and to study, improve and facilitate the administration of justice in Rhode Island.
